Terms of service
Terms of Service and Customer Information (US Customers)
I. General Terms and Conditions
§ 1 Basic Provisions
(1) These Terms and Conditions apply to contracts you conclude with us as the seller (Feltra) via the website https://feltra.de/en-us. Unless otherwise agreed, we object to the inclusion of any conflicting terms you may use.
(2) For purposes of these Terms, a "consumer" is any individual who enters into a transaction for purposes outside their trade, business, craft, or profession. A "business customer" is any individual or entity that enters into a transaction in the exercise of their trade, business, craft, or profession.
§ 2 Formation of the Contract
(1) The subject of the contract is the sale of goods.
(2) By listing a product on our website, we make you a binding offer to enter into a contract through the online shopping-cart system, on the terms stated in the product description.
(3) The contract is formed through the online shopping-cart system as follows: the goods intended for purchase are placed in the "cart." You can view the "cart" at any time using the corresponding navigation button and make changes there. After clicking the "Checkout" or "Proceed to Order" button (or a similarly labeled button) and entering your personal data, payment, and shipping details, the order data is displayed to you once more as an order summary.
If you select an instant-payment system (e.g., PayPal, Apple Pay, Google Pay) as your payment method, you will either be taken to the order summary page in our online store or forwarded to the website of the instant-payment provider. If you are forwarded to the instant-payment system, you make the relevant selections or enter your data there. Finally, the order data is displayed to you as an order summary, either on the provider's website or after you are redirected back to our store.
Before submitting the order, you may review the information in the order summary again, change it (including by using the "back" function of your browser), or cancel the order.
By submitting the order using the corresponding button ("Order with obligation to pay," "Buy now," "Pay now," or a similarly labeled button), you make a legally binding declaration of acceptance of the offer, and the contract is thereby formed.
(4) Order processing and the transmission of information required in connection with the conclusion of the contract take place partly by automated e-mail. You must therefore ensure that the e-mail address you provide to us is accurate and that receipt of our e-mails is technically possible, in particular that it is not blocked by spam filters.
§ 3 Special Provisions on Available Payment Methods
(1) Payment via "Shopify Payments." If you select a payment method offered through "Shopify Payments," payment processing is carried out by the payment service provider Stripe Payments Europe Limited (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland; "Stripe") within the Shopify Payments platform. The individual payment methods available through "Shopify Payments" are shown under a correspondingly labeled button on our website and during checkout (including credit card, Apple Pay, Google Pay, and Klarna). "Shopify Payments" may use additional payment services for processing; if special payment terms apply, you will be notified separately.
(2) Payment via "PayPal" / "PayPal Checkout." If you select a payment method offered through "PayPal" / "PayPal Checkout," payment processing is carried out by the payment service provider PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22-24 Boulevard Royal, L-2449 Luxembourg; "PayPal"). The individual payment methods available through "PayPal" are shown under a correspondingly labeled button on our website and during checkout. "PayPal" may use additional payment services for processing; if special payment terms apply, you will be notified separately. Further information on "PayPal" is available at paypal.com/webapps/mpp/ua/legalhub-full.
§ 4 Right of Retention, Reservation of Title
(1) You may exercise a right of retention only to the extent it concerns claims arising from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
§ 5 Warranty
(1) The applicable statutory warranty rights apply.
(2) As a consumer, you are asked to inspect the goods promptly upon delivery for completeness, obvious defects, and transport damage, and to notify us and the carrier of any complaints as soon as possible. Failure to do so has no effect on your statutory warranty rights.
(3) If a feature of the goods deviates from the objective requirements, such deviation is deemed agreed only if you were informed of it by us before submitting your order and the deviation was expressly and separately agreed between the parties.
§ 5a Returns
We offer a 30-day return policy. If you are not satisfied with your order, contact support@feltra.de with your order number within 30 days of receipt to arrange a return. Your statutory rights remain unaffected.
§ 5b Subscription Service
We offer an optional subscription for certain products: one pack per month for $24.99. You may skip a shipment or cancel your subscription at any time before the next billing date by contacting support@feltra.de or through your account settings. Unless skipped or cancelled before the next billing date, the subscription renews automatically and is billed at the then-current subscription price.
§ 6 Choice of Law
(1) German law applies. For consumers, this choice of law applies only to the extent it does not deprive you of the protections afforded by mandatory provisions of the law of the country in which you have your habitual residence (principle of favorability).
(2) The United Nations Convention on Contracts for the International Sale of Goods (CISG) expressly does not apply.
